Is it legal to text customers back automatically?

Often yes, if you have the right consent and your number is registered with the carriers. Replying to someone who just called or wrote to you is the lowest risk case, but consent and registration rules still apply, so set them up before you turn anything on.

The Telephone Consumer Protection Act requires consent before sending automated texts. Marketing texts need stronger, written consent than simple informational replies. Every message should say who it is from and how to opt out, and opt outs must be honored right away.

Carrier registration

US carriers require businesses that text from standard 10 digit numbers to register their brand and how they use texting, a process called A2P 10DLC registration. Texting providers handle the paperwork and charge small fees. Unregistered traffic gets filtered or blocked.

Safe defaults we use

  • Reply only to people who contacted you first.
  • Identify your business in the first message.
  • Include opt out instructions.
  • Never send marketing to people who only asked a question.
  • Keep a record of when and how each person opted in.
